As the SCA, the NTMA also manages claims for legal costs against the State and delegated State authorities. The SCA provides claims and risk management services through two State Indemnity Schemes: Clinical Indemnity Scheme: the SCA manages clinical negligence claims taken against healthcare enterprises, hospitals and clinical, nursing and allied healthcare practitioners covered by the scheme. General Indemnity Scheme: the SCA manages personal injury and third-party property damage claims taken against the State and delegated State Authorities. The "risk universe" indemnified by the State through these schemes is extensive. It includes over 200,000 State employees and all public healthcare service users. It includes public services that, by their nature, constitute higher-risk activities, such as the provision of clinical care in hospitals, Defence Forces personnel on operations overseas, members of An Garda Sochna on operational duty, customs inspections, emergency response services and the custody of prisoners. Role Summary & Principal Accountabilities The SCA requires a solicitor with expertise in personal injury litigation and in data protection law to join its general litigation unit. The role is split between acting on behalf of delegated state authorities in litigated personal injury, property damage and data protection claims, and supporting the management and implementation of privacy governance within the SCA. The responsibilities of the role will include: Litigation Actively manage a portfolio of litigation files across all court jurisdictions comprising employer liability, public liability, data protection, motor and property damage claims. Handle client queries prior to issuance of proceedings. Manage file from start to finish Provide opinion on liability, quantum and tactics once proceedings have issued. Monitor and advise on significant developments throughout the life of the claim Conduct settlement negotiations where appropriate Manage claims in accordance with State litigation principles and NTMA values, with a focus on resolving appropriate claims at the earliest opportunity. Develop and maintain good working relationships with our clients and stakeholders. Keep up to date with legislative changes and case law including developments in other jurisdictions. Privacy Work as part of the privacy team to meet the requirements of GDPR and Data Protection legislation and manage privacy governance implementation in the SCA. Provide legal support for management of privacy matters for SCA, to include; Managing and responding to access requests received by SCA, including data subject access requests and requests pursuant to Section 41 of the Data Protection Act 2018 Drafting and reviewing of privacy related policies, procedures, and documents including DPIA's, privacy notices, QP's, Record of Processing Activities, Data Protection Agreements, Transfer Impact Assessments and System access Terms and Conditions Provide legal and privacy advice to all SCA business units as required, for example, on data retention, and privacy queries relating to delegated State authorities Contribute to privacy related reviews and audits ( internal and external) and implement and take action on review recommendations. Assist in the management of a contracts database to ensure SCA's ongoing compliance with Article 28 GDPR Create and deliver training for the SCA on privacy and GDPR in collaboration with SCA Training Manager and NTMA DPO Experience Third level degree. A minimum of 3 years PQE as a qualified solicitor Post graduate data protection qualifications and /or experience A knowledge and understanding of the public sector Experience of successfully managing projects to completion within deadlines Skills In-depth knowledge of Data Protection Legislation Solid experience of personal injury litigation Excellent organisational skills Strong interpersonal relationship and communication skills Ability to lead and motivate others to meet objectives Ability to prioritise and complete tasks and meet deadlines Self-directed, willing to take ownership of tasks Bring collaborative approach to tasks Work as part of team and also be able to work independently Close attention to detail Pragmatic and practical approach to problem solving.
