Overview
The Legal Advisor and FOI & GDPR Compliance Officer will be the technical expert responsible for the management of claims and coroners inquests. The Legal Advisor and GDPR Compliance Officer is also responsible for the management of general data protection obligations, ensuring that the Hospital is compliant with the legislation.
Key responsibilities include:
* To liaise with the external legal advisors and assisting in the provision of instructions to those advisors, subject to the provision of the HSE arrangement for the provision of legal services.
* Liaise with the State Claims Agency regarding information requests that may be related to Clinical Claims.
* The processing of all FOI, data protection, administration access and PQ requests.
* Advising the Hospital Executive on any data protection issues with regard to the exchange of information with other agencies and for any contracts or services.
* Overseeing the management of the organisation's data protection non-compliances and breaches.
* To co-ordinate the implementation of the Data Protection quality improvement plan.
To provide management support within a function and to supervise staff within own remit.

Essential Criteria
This campaign is confined to staff who are currently employed by the HSE, TUSLA, other statutory health agencies*, or a body which provides services on behalf of the HSE under Section 38 of the Health Act 2004 as per Workplace Relations Commission agreement -161867

Each candidate must on closing date for applications:
(a) Have satisfactory experience in an office under the HSE, TUSLA, other statutory health agencies, or a body which provides services on behalf of the HSE under Section 38 of the Health Act 2004 at a level not lower than that of Grade IV (or equivalent)
and
(b) Have not less than two years satisfactory experience either in that office or in an office at a level not lower than that of Clerical Officer Grade V in the HSE, TUSLA, other statutory health agencies, or a body which provides services on behalf of the HSE under Section 38 of the Health Act 2004
and
(c) Must have a legal professional qualification and relevant experience in FOI and data governance
and
(d) Candidates must possess the requisite knowledge and ability, including a high standard of suitability, for the proper discharge of the office.
Post Specific Criteria:
Data protection related qualification such as CDPO, CIPP/E, or equivalent.
